  1. Applicable general conditions:

The model agreement relating to architectural and related services is available on the website www.aas3.be or provided during contract negotiation. Conditions are available in French. Belgian law applies, and disputes are resolved before a Belgian court. Please note that when signing the agreement outside the office, the client has a right of withdrawal to be exercised within 14 days, using the “withdrawal” letter model attached or any other model containing the same information.

For technical advice and expertise missions, the conditions in this sheet apply without withdrawal. In case of dispute, only the courts of the expert’s region have jurisdiction.

  1. Fee calculation method:

The precise pricing of the company’s services will depend both on the billing method agreed in the contract between parties and on the type of mission entrusted. 

Unless otherwise requested by the client, for architectural and related missions, AAS3 srl generally applies fixed fees based on an internal hourly estimation of services or on a percentage of the actual cost of the work. 

However, technical advice and expertise missions are systematically subject to an itemized calculation of services and expenses.

The calculation method used is specified in the negotiated agreement binding the parties. Note:

These amounts are indexed according to the consumer price index (base index: month preceding the date of signing the agreement). Each started hour is fully payable. Hourly rates are automatically increased by 20%, independently of the consumer price index, for services performed outside legal working days and/or work in the evening (after 8 p.m.).

  1. Payment terms

Fees for architectural services are payable progressively according to the mission’s progress and in installments as specified in the agreement. Any started phase of progress is fully payable.

For partial missions or any other specific company mission, any possible installment plan and/or terms will be specified in the agreement.

Fees are payable no later than the thirtieth day after the invoice date. Failing that, late payment interest will be charged at 1.5% per month of delay without prior formal notice. Moreover, the outstanding fees will automatically be increased by 10% as a penalty clause, independently of legal costs and interest.

  1. Characteristics of the service provided

The company’s missions are diverse, considering the multidisciplinary nature of its composition. They may include in particular:

  • complete, partial, or limited architectural missions related to the construction, extension, or conversion of a building; all in accordance with the legislation and case law in the field;
  • PEB responsibility missions;
  • health and safety coordination missions;
  • certain project engineering missions;
  • expertise and/or real estate evaluation missions;
  • pre- and post-work site surveys, or rental condition surveys;
  • missions generally assigned to surveyors (measuring, boundary marking, …); missions for project management assistance, project management and/or consulting; sustainable development management missions.
  1. Delivery dates:

Our initial advice is usually provided within a maximum of 30 days after the first meeting and/or site visit, or as agreed between the parties.

The timeframe for the actual missions will be determined by phase in the linked agreements. 

  1. Insurance

We have concluded a Professional Liability insurance policy with AR-CO insurance company, Rue Tasson-Snel 22, 1060 Brussels, tel. 02/538.66.33, approved by BNB and FSMA under number 0330, RPM 0406 067 338. Territorial scope of coverage: Belgium and Luxembourg.

  1. Termination

The General Conditions determine in article 12 the cases of contract termination based on, on the one hand, the terms of unilateral termination provided for in article 1794 of the Civil Code and, on the other hand, the termination methods possible in the event of non-compliance with the obligations of one party and special cases.

Withdrawal letter

Dear Sir or Madam, 

You have the right to withdraw from this contract without giving any reason within fourteen days. The withdrawal period expires 14 days after the day of signing the contract, signed at your home and only in that case. Please return this duly completed, dated, and signed form to our office by post or email.

Access to your personal data is strictly limited to our administrative staff, employees and agents, communication department, or accounting department, and, if applicable, to our subcontractors. These subcontractors are bound by confidentiality and can only use your data in accordance with our contractual terms and applicable legislation. Except for the cases stated above, we commit not to sell, rent, transfer, or grant third-party access to your data without your prior consent, unless required due to a legitimate reason (legal obligation, fraud or abuse prevention, defense of rights, etc.).   

In accordance with European Regulation No. 2016/679/EU of April 27, 2016 (applicable from 

May 25, 2018), you benefit from the right of access, rectification, portability, and deletion of your data or limitation of processing. You may also object to processing of your data for legitimate reasons.

The personal data that may be collected on the Site are as follows:  

Account/profile creation: when creating your account/profile, among other things, your last name, first name, birth date, postal address, email address, phone number, and connection data are recorded.  

Site connection: on this occasion, your connection data, browsing data, or location data are recorded.  

Payments on the site: in case of financial transaction on the site, your bank details or credit card data are recorded.  

Online discussions: when you communicate with other users on the site, data related to these exchanges are recorded.  

Information from third parties: some of your data (especially your last name, first name, and telephone and/or postal contact details) may have been transmitted to us, with your prior consent, by our partners. In this case, the processing of your data will be governed by these stipulations.  

Contact: when you fill out the contact form, your last name, first name, email address, and your message are collected.  

Cookies: Cookies are used within the framework of the use of the Site to collect certain information (in particular, your IP address, information about the computer used for browsing, connection mode, type and version of the browser, operating system, other technical identifiers, or the URL address of connections, including the date and time, as well as content accessed).   

You have the possibility to disable Cookies via your browser settings.  

The uses of your personal data are mainly as follows:

During this period, the Site implements organizational, software, legal, technical, and physical means to ensure the confidentiality and security of your personal data to prevent their damage, deletion, or access by unauthorized third parties.   

Access to your personal data is strictly limited to the employees and agents of AAS3 srl, authorized by their duties and bound to confidentiality. However, collected data may possibly be communicated to subcontractors contractually responsible for carrying out tasks necessary for the proper functioning of the Site and its services as well as proper management of the relationship with you, without you needing to give authorization. It is specified that, in performing their services, subcontractors have only limited access to your data and have a contractual obligation to use them in accordance with applicable data protection legislation. Except for the above cases, AAS3 srl commits not to sell, rent, transfer, or grant third parties access to your data without your prior consent, unless compelled for legitimate reasons (legal obligation, fraud or abuse prevention, defense of rights, etc.).  

In accordance with European Regulation No. 2016/679/EU of April 27, 2016 (applicable from May 25, 2018), you have the following rights:   

  • Update or delete your data by logging into your account and adjusting its settings;
  • Exercise your right of access to know the personal data concerning you;
  • Request the updating of your data if incorrect;
  • Request portability or deletion of your data; ·    Request deletion of your account;  
  • Request limitation of processing your data;
  • Object, for legitimate reasons, to the processing of your data;
  • Object or withdraw your consent for our services to use your contact details to send promotions and solicitations via emails, SMS, phone calls and postal mailings. This right applies whether the information concerning you was provided directly by you or by third-party partners to whom you have given your consent (in which case you should use the unsubscribe links provided in our SMS, emails, or contact us).

These various rights can be exercised either by modifying your account settings, directly on the Site under the “Contact” section, or by writing to: info@aas3.be. For security reasons and to avoid fraudulent requests, this must be accompanied by a valid proof of identity. The proof will be destroyed once the request is processed.

A Cookie is information stored on your browsing device by the server of the visited Site.

The information collected by these means will only be used to track the volume, type, and configuration of traffic using the site, to develop its design and arrangement, for administrative and planning purposes, and more generally to improve the service we offer you.

IMAGE RIGHTS OF PRIVATE PROPERTY

Principle

Property is the right to enjoy and dispose of things in the most absolute manner, provided it is not used in a way prohibited by laws or regulations.

Everyone has the right to control the image of their property.

Therefore, photographing a private property and using the photograph in principle requires the owner’s authorization.

Exception

The owner of a property whose image is used can take legal action only if they prove that such use causes them abnormal and certain disturbance to their right to use and enjoy the property in question. 

GENERAL TERMS OF SALE OR INTERVENTION  

  1. Ensure the presence of this in the GTC/CGI

When collecting telephone numbers from a consumer, the professional must inform them of their right to register on the telephone solicitation opposition list. When this information is collected upon conclusion of a contract, the contract clearly and understandably mentions this right for the consumer.  

  1. Clause related to personal data in the GTC/CGI

Personal data collected by the company through the quote (name, first name, birth date, address, phone, email, bank details, etc.) are recorded in its client file and mainly used for proper client relationship management and order processing (prevention of unpaid invoices, 

prospecting, etc.). The quote marks with an asterisk the information essential for the proper execution of the order.  

Collected personal data will be kept as long as necessary until the order is processed / contract executed, unless:   

  • A longer retention period is authorized or required by law or regulations;
  • The client has exercised one of the rights granted to them by law under the conditions below.
  • A legitimate reason justifies the keeping of the data.

Access to personal data is strictly limited to the company’s employees and agents authorized to process them by virtue of their functions. Collected information may be shared with third parties contractually linked to the company for carrying out subcontracted tasks necessary for order management, without needing client authorization. It is specified that, in performing their duties, these third parties have only limited access to data and are contractually bound to use it in compliance with applicable personal data protection laws. Except for the cases set above, the company commits not to sell, rent, transfer, or grant third-party access to data without prior client consent, unless compelled by legitimate reasons (legal obligation, fraud or abuse prevention, defense of rights, etc.).  

In accordance with applicable legal and regulatory provisions, especially European Regulation No. 2016/679/EU of April 27, 2016 (applicable since May 25, 2018), the client has the right of access, rectification, portability, and deletion of their data or limitation of processing. They can also object, for legitimate reasons, to the processing of their data.

If the client does not wish to receive promotional messages and invitations by emails, SMS, phone calls, or postal mail, they can indicate their choice during order finalization, modify it by contacting the company as indicated above, or use unsubscribe links available in messages. This right also applies to persons whose data (identity and contact details) was transmitted to the company by third parties for commercial prospecting purposes with their consent.
